This Privacy Notice describes how SAINKA TECH LLC, a limited liability company formed in the State of Delaware, United States of America, collects, uses, stores, protects, shares, and, where applicable, transfers personal data related to Alusystem Software, its websites, applications, platform, subscription services, technical support, and communication channels.

By providing personal data, registering, contracting, accessing, or using Alusystem Software or any related services, you acknowledge that this Privacy Notice has been made available to you. When applicable law requires express consent, SAINKA TECH LLC will request it through the corresponding means.

1.- Definitions

1.1.- SAINKA TECH LLC

Refers to the company responsible for the processing of personal data and the operator of Alusystem Software.

1.2.- Alusystem Software or Platform

Refers to the software, web application, website, system, tools, subscription services, and functionalities operated by SAINKA TECH LLC.

1.3.- Client

Refers to the individual or legal entity that contracts, registers, accesses, or uses the Platform.

1.4.- User

Refers to any person authorized by the Client to use the Platform or access an account linked to the Client.

1.5.- Personal Data

Refers to any information concerning an identified or identifiable natural person.

1.6.- Sensitive Personal Data

Refers to data that may reveal intimate aspects or lead to discrimination, such as racial or ethnic origin, health status, genetic information, religious beliefs, political opinions, union membership, sexual orientation, or other equivalent data under applicable law.

2.- Personal Data We May Collect

SAINKA TECH LLC may collect the following personal data, depending on the way the Client or User interacts with the Platform:

Contact and communication	Email address, telephone number, messages sent to support, history of requests, clarifications, or complaints.
Billing and administration	Tax or billing data, legal business name, tax address, tax identification number or taxpayer registration, and information necessary to issue receipts, invoices, or payment records.
Account and subscription	Contracted package, registration date, renewal date, subscription status, payment history, charge status, customer or subscription identifiers generated by payment processors.
Technical and device data	IP address, browser, operating system, device type, technical identifiers, access logs, date and time of use, errors, security events, and data necessary for technical support.
Platform usage	Usage preferences, selected suppliers, materials, settings, generated quotes, frequency of use, number of quotes, and operational metrics necessary to improve the service.
Data entered by the Client	Information that the Client voluntarily enters into the Platform to generate quotes, manage projects, or use available features, including third-party data if captured by the Client under the Client’s own responsibility.
Technical support	Screenshots, description of errors, device information, system version, internet provider, files, or technical information provided by the Client to resolve incidents.

SAINKA TECH LLC does not request sensitive personal data for the ordinary use of the Platform. The Client and Users must refrain from entering sensitive personal data in free-text fields, files, support messages, or quotes, unless strictly necessary and unless they have the corresponding authorization. If such data is provided without being requested, SAINKA TECH LLC may delete it, block it, or limit its processing when technically possible and legally appropriate.

3.- Payment Information

SAINKA TECH LLC may use external payment processors and payment gateways to manage charges, subscriptions, and renewals. SAINKA TECH LLC does not store complete bank card numbers, security codes, or complete banking credentials of the Client.

However, SAINKA TECH LLC may receive and retain information necessary to manage the business relationship, such as payment confirmation, amount, date, currency, charge status, contracted plan, customer or subscription identifiers, the last digits or brand of the payment method when provided by the processor, as well as data necessary for clarifications, support, billing, accounting, fraud prevention, and legal compliance.

Data processing carried out directly by external payment processors will also be governed by their own terms, conditions, and privacy notices.

4.- Primary Purposes of Processing

Personal data will be used for purposes necessary to provide Alusystem Software services, including:

Creating, administering, validating, and protecting Client and User accounts.
Processing registrations, subscriptions, renewals, payments, cancellations, and clarifications.
Providing access to the Platform and to the features included in the contracted package.
Providing technical support, customer service, maintenance, error resolution, and incident follow-up.
Issuing receipts, invoices, payment records, accounting records, and administrative documentation when necessary.
Verifying identity and preventing fraud, abuse, unauthorized access, misuse, and security risks.
Complying with legal, tax, accounting, regulatory, contractual obligations, or requests from competent authorities.
Keeping records necessary for operation, legal defense, security, audits, and administration of the contractual relationship.

5.- Secondary Purposes

Additionally, SAINKA TECH LLC may use personal data for purposes that are not essential for the provision of the service but help improve the Client or User experience, such as:

Sending commercial communications, promotions, updates, surveys, information about new packages, or Platform improvements.
Analyzing aggregated usage metrics to improve features, materials, suppliers, quoting processes, performance, and user experience.
Conducting internal studies, statistical reports, usability testing, and usage behavior analysis in an aggregated or dissociated manner whenever possible.

The Client or User may object to the use of their data for secondary purposes by sending a request to admin@alusystemsoftware.com. Refusal to allow the use of data for secondary purposes will not be a reason to deny the requested services, provided that such refusal does not prevent compliance with the primary purposes necessary for the contractual relationship.

6.- Third-Party Data Entered by the Client

When the Client enters personal data of its own customers, prospects, employees, suppliers, or third parties into the Platform, the Client will be responsible for having the authorizations, privacy notices, legal bases, and authority necessary to capture, upload, store, or process such information in the Platform.

Regarding such data captured by the Client, SAINKA TECH LLC will act only to the extent necessary to provide the contracted service, operate the Platform, provide support, maintain security, and comply with applicable obligations. The Client agrees not to upload sensitive personal data or third-party information that the Client is not authorized to process.

7.- Cookies, Tracking Technologies, and Technical Records

The Platform and websites related to Alusystem Software may use cookies, server logs, technical identifiers, analytics tools, performance measurement tools, and similar technologies to operate the site, remember preferences, maintain active sessions, improve security, detect failures, measure use, and improve the user experience.

The User may configure their browser to block or delete cookies. However, some Platform features may not operate correctly if certain cookies or technologies necessary for the operation of the service are disabled.

SAINKA TECH LLC does not sell personal data. If personalized advertising technologies or data exchanges for advertising purposes that require consent or opt-out options are implemented in the future, users will be informed in accordance with applicable law.

8.- Transfers and Disclosure of Personal Data

SAINKA TECH LLC may share or transfer personal data only when necessary for the purposes described in this Privacy Notice, when there is a legal obligation, when required by a competent authority, when necessary to protect the rights of SAINKA TECH LLC, the Client, or third parties, or when permitted by applicable law.

Cloud, hosting, infrastructure, backup, storage, cybersecurity, and database administration service providers.
Email, messaging, technical support, customer service, and communication tool providers.
Payment processors or gateways, financial institutions, card networks, and fraud prevention providers.
Analytics, monitoring, performance, error diagnosis, and Platform improvement providers.
Legal, accounting, tax advisors, auditors, authorities, or third parties when necessary for legal compliance or defense of rights.
Affiliated, related, successor, acquiring, or assignee companies in the event of corporate reorganization, merger, acquisition, asset sale, financing, restructuring, or business transfer.

Personal data may be processed or stored in the United States of America, Mexico, or other countries where service providers used by SAINKA TECH LLC are located. When applicable, SAINKA TECH LLC will seek to ensure that such third parties assume confidentiality, security, and processing obligations consistent with the authorized purposes.

9.- Retention of Personal Data

SAINKA TECH LLC will retain personal data for the time necessary to fulfill the purposes described in this Privacy Notice, while there is an active account, active subscription, contractual relationship, legal, tax, accounting, administrative, security, or legal defense obligation.

When personal data is no longer necessary for the purposes that motivated its processing, SAINKA TECH LLC will seek to delete, block, anonymize, or limit its retention according to the applicable legal, technical, and operational periods.

10.- Security Measures

SAINKA TECH LLC maintains reasonable administrative, technical, and physical measures to protect personal data against damage, loss, alteration, destruction, unauthorized use, access, or processing. These measures may include access controls, authentication, backups, activity logs, internal restrictions, encryption where applicable, and reasonable security practices for the type of service provided.

However, no system, website, application, database, communication network, or technology platform is completely secure or failure-free. The Client and User are also responsible for protecting their credentials, devices, email accounts, passwords, networks, and access methods.

If the Client or User detects a possible security breach related to their account, they must notify SAINKA TECH LLC at admin@alusystemsoftware.com as soon as possible.

11.- ARCO Rights, Revocation, and Limitation of Use

Where permitted by applicable law, the data subject may exercise the rights of Access, Rectification, Cancellation, and Opposition (ARCO rights), as well as request revocation of consent or limitation of the use or disclosure of personal data.

To exercise these rights, a request must be sent to admin@alusystemsoftware.com with the following information:

Full name of the data subject or their legal representative.
Means to communicate the response.
Clear description of the right to be exercised and the related personal data.
Documents proving identity or legal representation, when necessary.
Any additional information that facilitates the location of the personal data.

SAINKA TECH LLC will address requests within the applicable legal timeframes. When Mexican personal data protection law applies, SAINKA TECH LLC will communicate the adopted determination within a maximum period of twenty days from receipt of the request and, if the request is appropriate, will make it effective within fifteen days following the communication of the response, unless a legally permitted extension applies.

The exercise of rights may be denied or limited when there is a legal impossibility, retention obligation, impact on third-party rights, failure to prove identity, absence of data in possession of SAINKA TECH LLC, or any other cause permitted by applicable law.

12.- Additional Rights Depending on Jurisdiction

Depending on your place of residence and the applicable law, certain individuals may have additional rights, such as confirming whether their personal data is processed, obtaining a copy of their data, requesting correction or deletion, obtaining portability, objecting to certain processing activities, limiting the use of sensitive data, opting out of the sale of personal data or targeted advertising, and not being discriminated against for exercising privacy rights.

The Platform is intended for adults and businesses. SAINKA TECH LLC does not seek to intentionally collect personal data from minors. If it becomes known that data from a minor was collected without the corresponding authorization, deletion may be requested at admin@alusystemsoftware.com.

14.- Commercial Communications

SAINKA TECH LLC may send communications related to account operation, subscriptions, payments, support, security, contractual changes, or important service notices. These communications are necessary for the contractual relationship and may not always be disabled while an active account or subscription exists.

Non-essential promotional or informational communications may be limited or cancelled by sending a request to admin@alusystemsoftware.com or through the mechanisms available in each communication, when available.

SAINKA TECH LLC may modify, update, or add to this Privacy Notice when necessary due to legal, operational, technical, commercial, security, service, provider, or personal data processing practice changes.

Changes to this Privacy Notice will be published on the website, within the Platform, or communicated through reasonable means. The current version will be the one published or available at the time the Platform is used.

17.- Applicable Law

This Privacy Notice shall be interpreted in accordance with the law applicable to the corresponding personal data processing activity. For Clients and Users located in Mexico, the applicable provisions regarding personal data protection held by private parties will be taken into consideration. For residents of other jurisdictions, additional rights and obligations may apply according to local law.
